1. Introduction
Incline Labs, LLC (“Incline,” “we,” “us,” or “our”) operates a cloud-based back-office software platform (the “Platform”). This Privacy Policy explains how we collect, use, store, and protect information when you access or use the Platform.
This Privacy Policy applies to all users of the Platform. It does not grant any license or rights to Incline’s software, intellectual property, or proprietary technology. All such rights are governed exclusively by Incline’s Master Subscription Agreement (MSA) or other written agreements between you and Incline.

3. Information We Collect
We may collect the following categories of information:
a. Account and Business Information
Business name, location, and contact details
User names, roles, and permissions
Subscription and billing-related metadata
b. Operational and Usage Data
Inventory, sales, pricing, and reporting data submitted to the Platform
Configuration settings and feature usage
Log files, timestamps, and activity history
c. Technical Information
IP address, browser type, device identifiers
Operating system and session data
Error logs and diagnostic data
Incline does not intentionally collect sensitive personal information unless required to operate the Platform.
4. How We Use Information
We use collected information solely to:
Operate, maintain, and support the Platform
Provide customer support and system communications
Monitor performance, security, and system integrity
Improve functionality, reliability, and user experience
Comply with legal and regulatory obligations
We do not use Customer Data for advertising or sell it to third parties.
5. Data Ownership and Control
All data you submit to the Platform remains your property (“Customer Data”).
By using the Platform, you grant Incline a limited, non-exclusive right to process Customer Data only as necessary to operate, maintain, secure, and improve the Platform.
This Privacy Policy does not transfer ownership of any data or grant any rights beyond those required for Platform operation.
6. Aggregated and Anonymized Data
Incline may generate and use aggregated or anonymized data derived from Customer Data for:
Analytics and benchmarking
Platform optimization
Product development and research
Such data does not identify you or your business and is not considered Customer Data.
7. Data Security
Incline implements commercially reasonable administrative, technical, and organizational safeguards consistent with industry best practices to protect data against unauthorized access, disclosure, alteration, or destruction.
No system is completely secure. You acknowledge that transmission of data over the internet carries inherent risk.
8. Data Retention
We retain Customer Data for as long as necessary to:
Provide the Platform
Comply with legal obligations
Resolve disputes
Enforce agreements
Upon termination of your account, data may be retained or deleted after a reasonable retention period, subject to legal, regulatory, and operational requirements.
9. Third-Party Services
The Platform may integrate with third-party services, APIs, or POS systems.
Incline is not responsible for the privacy practices, security, or data handling of third parties. Use of third-party services is governed by their respective policies and agreements.
10. International Data Transfers
Incline operates from the United States.
If you access the Platform from outside the United States, you acknowledge and agree that your data may be transferred to, stored, and processed in the United States.
You are responsible for ensuring compliance with local data protection laws applicable to your jurisdiction unless otherwise agreed in writing.
11. Legal Basis and Compliance
Unless explicitly agreed otherwise in writing, Incline does not represent compliance with non-U.S. data protection frameworks such as GDPR, UK GDPR, or other international privacy regimes.
Enterprise or jurisdiction-specific compliance obligations must be addressed through a separate written agreement.
12. Relationship to Master Subscription Agreement
This Privacy Policy governs data handling and privacy practices only.
All terms related to:
Software licensing
Intellectual property ownership
Restrictions on copying, reverse engineering, or redistribution
Confidentiality and trade secrets
are governed exclusively by Incline’s Master Subscription Agreement (MSA) or other executed agreements, which shall control in the event of any conflict.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be communicated through the Platform or via email. Continued use of the Platform constitutes acceptance of the updated Privacy Policy.
